Gorsuch Confirmation or Witch Hunt

Feinstein then described a 21-week abortion as the kind of abortion at stake if Gorsuch’s nomination is confirmed.

Brian Burch of CatholicVote responded to the attacks.

“Already, Democratic Senators are on the attack. They understand the historic nature of this nomination. Left-wing groups have used the courts and reckless judicial decisions to impose their agenda on the people. But that could all end soon,” he said. “Judge Gorsuch has pledged to obey the Constitution and to respect the limited role of judges. Judges are not policy makers. Judges are not politicians. And when the Supreme Court restrains itself, the Left typically loses.”
Some liberal interest groups and advocates are calling on the Senate to put off confirmation of President Donald Trump’s Supreme Court nominee while the FBI is investigating possible links between the Trump campaign and Russia.

Harvard Law professor Laurence Tribe tweeted Tuesday morning that it’s a “sensible rule” to withhold approval for nominee Neil Gorsuch for as long as the investigation continues.

Senate Majority Leader Mitch McConnell’s decision in March 2016, to sit on President Obama’s nomination of Merrick Garland to replace Antonin Scalia was the most consequential political act of the year. The tangible promise of a judicially and socially conservative Supreme Court justice was a critical factor in Donald Trump garnering an 80% share of white Evangelicals and 60% of white Catholics despite his substantial moral shortcomings. It also gave the conservatives an opportunity to hold their majority on the Supreme Court for at least a decade.

The Gorsuch confirmation will not change the Court which has long been 4 conservatives, 4 liberals, and Anthony Kennedy who votes with the conservatives much of the time. With the 49 year old Gorsuch, it does extend the time horizon, and if Kennedy (age 80) chooses to retire, the team of Roberts (age 62), Alito, (age 66), and Thomas (age 68) could gain a fifth vote to carry it for a decade. While Kagan (age 56), and Sotomayor (age 62) will be around, the Ginsberg (age 83), and Breyer (age 78) seats could make it as much as a 7-2 conservative majority before Trump leaves office.

"We want all senators to vote against Judge Gorsuch, including all procedural votes," said Shin Inouye, communications director for the progressive Leadership Conference on Civil and Human Rights.

"They're trying to build a case for the heightened level of partisanship their base is asking for," said Carrie Severino, chief counsel and policy director for the conservative Judicial Crisis Network, of the Democrats who pressed Gorsuch hard during his confirmation hearings.

But Democrats have some practical reasons to be cautious. Gorsuch is conservative, but he isn't in involved in any scandals, there are no concerns about his qualifications, and he has received positive reviews for his performance at the hearings.

In E-mails, Neil Gorsuch Praised a Leading Republican Activist Behind Voter Suppression Efforts

Few people in the Republican Party have done more to limit voting rights than Hans von Spakovsky. He’s been instrumental in spreading the myth of widespread voter fraud and backing new restrictions to make it harder to vote.

But it appears that von Spakovsky had an admirer in Neil Gorsuch, Donald Trump’s nominee for the Supreme Court, according to e-mails released to the Senate Judiciary Committee covering Gorsuch’s time working in the George W. Bush Administration.

When President Bush nominated von Spakovksy to the Federal Election Commission in late 2005, Gorsuch wrote, “Good for Hans!”

NPR released a startling story: According to one of the judge’s former law students, Jennifer Sisk, Gorsuch once made an extraordinarily sexist classroom comment. Sisk alleges that in April 2016, Gorsuch “interrupted our class discussion to ask students how many of us knew women who used their companies for maternity benefits, who used their companies to—in order to have a baby and then leave right away.”

When few students raised their hand, Gorsuch reportedly “became animated” and said, “Come on, guys. All of your hands should be up. Many women do this.” He later added, in Sisk’s words, that “companies have to ask these sort of questions at the interview so that companies can protect themselves.” Sisk brought her concerns to two deans, but it’s unclear whether they ever spoke to Gorsuch.

First was Boyden Gray:

“The best part of what Gorsuch has done is taken on the administrative state,” Gray began, going on to discuss to how much deference courts give to government agencies on how to interpret statutes and make regulations. This was also a reference to courts invalidating administrative actions under laws like the Religious Freedom Restoration Act (RFRA) when those agencies adopt rules that violate religious-liberty rights.

Second was Mike Carvin:

“This guy goes deep,” Carvin said of Gorsuch, describing him as someone who thoroughly explores “every rabbit hole” offered by lawyers arguing at his Denver-based appeals court. Carvin added that Gorsuch routinely responds with a “meticulous” analysis to such arguments, instead of merely brushing them aside, as Carvin admitted he would do himself if he were a judge listening to such arguments.

Third was Ed Whelan:

Whelan characterized Gorsuch as an “eminently worthy successor” to the justice for whom Whelan had clerked, adding that there was perhaps no higher praise he could offer. Whelan was especially concerned about government actions and judicial opinions that are “deeply hostile to the American tradition of religious liberty,” expressing optimism that Gorsuch would be a vote toward building a Supreme Court majority that could reverse that trend.

Senate Democrats are trying to grill Supreme Court nominee Judge Neil Gorsuch, but it’s been a rather embarrassing spectacle. If these salvos are the best they’ve got, the might as well call it a night and accept reality: Gorsuch will be confirmed. But they won’t do that because Sen. Sheldon Whitehouse (D-RI) needs to know if Gorsuch knows the dynamics of the dark and surreptitious ad campaign being waged in support of his nomination. Whitehouse tried to used dark money to attack Gorsuch, which is quite interesting since he’s worked with left wing groups who do pretty much what the Right does concerning their issues. And yes, there are lefty groups, like Indivisible, CREDO Action, and People for the American Way, who are working to derail Gorsuch’s nomination.

The latest example of political hyperbole is that the U.S. Treasury is ready to default on its debt. An actual examination of the underlying facts is that the relative purchasing value of the currency has long ago swindled debt holder in U.S. Bonds of their promised returns. A default defined under this definition is part of the equation. Repudiation of the entire debt obligation is the real fear. Contrary to all the public scare tactics that the financial world will stop turning, the Federal Treasury has ample revenue to pay the interests on bonds and notes that come due. The essential issue is whether the new bond lenders are willing to roll over the debt that is coming due and keep the shell game going.

Is the Economy Viable?
