Backpacker Tax Changes – For Employers

If you employ backpackers (working holiday makers) from 1 January 2017 you will need to:
  1. Complete a once-off registration with the Australian Taxation Office by following this link: https://www.ato.gov.au/Business/Your-workers/Employers-of-working-holiday-makers/.
     
  2. Once registered, withhold tax at 15% on wages up to $37,000 for employees holding a 417 working holiday visa or a 462 work and holiday visa. A tax withholding table will be available from 1 January 2017.
Further information:
  • Employers who do not register will be required to withhold tax at 32.5% and may be subject to penalties if they employ the above visa holders without being registered.
     
  • You can confirm your employees’ visa type by following this link: http://www.border.gov.au/Busi/visas-and-migration/visa-entitlement-verification-online-(vevo).
     
  • Existing employees do not need to complete a new tax file number declaration form however they should inform you of their visa type to ensure you withhold the correct amount of tax.
     
  • Other employees holding different visas to those listed above will need to satisfy Australian tax residency requirements or be subject to non-resident tax withholding tax rates as per existing rules.
