Lavender Law 2019 Recap!

In August, our three attorneys Diana, Andy, and Bill attended the National LGBT Bar Association’s annual conference, Lavender Law. This fantastic conference is a family reunion of lawyers who are themselves LGBTQIA, from all practice areas, and ally attorneys who support LGBTQIA communities, such as through work in discrimination issues or assisted reproductive technology.

Diana and Andy spoke together on a panel on bisexuality and intersectionality that was very well-received, and co-hosted the BiLaw Caucus, a solidarity and networking space for non-monosexual law students and legal professionals. Diana also spoke on two panels discussing the forefront of assisted reproductive technology and LGBTQIA parenting, and polyamorous families with children. Diana, Andy, and Bill have the distinction of being personally responsible for bringing the discussion of polyamory to Lavender Law for the first time, when they spoke on the topic together several years ago! Andy also spoke on a panel of non-binary, intersex, and gender non-conforming lawyers about the practice of law as, and for, that population.

Our Of Counsel attorney Bill Singer is a legal legend, who founded our field of LGBTQ family law in his 49 years of legal practice. Bill is also a founder of the National LGBT Bar Association, which led to the enriching community we enjoy today. Bill also founded the LGBT Family Law Institute (FLI) which brings together legal leaders in LGBT family law, and now serves as International Director, while Diana serves as the Director of the european branch of this world-wide FLI network, and Andy and Diana both represent NY. Bill, Diana, and Andy enjoyed the US FLI annual meeting as part of the Lavender Law conference.

Bill, Diana, and Andy are working hard to expand the boundaries of the conversations in LGBTQIA legal spaces to include the diversity of clients and families that make up our clientele.

Lawyers & law students: Save the date for Lavender Law 2020 in Washington, DC, August 12-14, 2020. Our attorneys will be there!

Chosen Family Law Center - Trans Umbrella Project Case Studies

Our new nonprofit, Chosen Family Law Center, Inc., is up and running to support LGBTQ+ families, polyamorous families, and other chosen and underserved families with legal support, public education, and professional training for lawyers, mental health professionals and others to make sure these communities have access to culturally competent services they deserve.

Our first project, the Trans Umbrella Project, has been underway since February, and already we’ve taken on more than 15 cases.  Here are some short case studies prepared by Volunteer Attorney Bill Singer that explicate the difficulties, and importance, of this work for our trans and gender nonconforming community.

M.E.W. - Precedent-setting victory for trans privacy, in which we secured a waiver for an adult trans man in rural New Jersey of the requirement to publish his name change and gender marker change, and got records sealed.

O.N.M. - Waiving publication and sealing records for name and gender marker changes for a minor in rural New Jersey to protect them from violence from a parent.

We’re so grateful for the work of Volunteer Attorney Bill Singer who secured these potentially life-saving victories, which will be a powerful precedent for protecting the privacy of other trans people in New Jersey.

Read the full case studies here:

In addition to Trans Umbrella Project, CFLC is also taking cases of immigration adjustment of status petition for LGBTQIA people who have been granted asylum in the USA, second-parent adoption to protect the parenting status of non-biological parents such as a same-sex or trans partner of a birth mom, and Wills and life planning documents for for non-nuclear, polyamorous, and LGBTQIA families. And we’re finally hiring a graphic designer and web designer!

We have a separate quarterly newsletter for CFLC updates. Please sign up for the CFLC newsletter HERE and follow up on social media (FB, twitter) to hear about our work.

An Update from Bill Singer: Talks, Publications, and Presentations

Here are a few updates from our Of Counsel Attorney Bill Singer, who frequently travels to give talks and presentations on LGBTQ family law and civil rights:

On July 19, 2019, Bill addressed the New Jersey Judiciary Institute for Staff Attorneys, and the talk was transmitted to all of the vicinages in the state. Bill’s speech was entitled “Marriage Equality Was A Wave, Not A Finale,” raising awareness of the continuing battle for equality and justice for the LGBTQ community.

In the August 2019 issue of New Jersey Family Lawyer, Bill and his co-author Dr. Serena Chen published an article entitled “Creating Families Through Science and Law.” They wrote about the exponential growth in the use of Assisted Reproductive Technology (ART) to help people create families, and what family law you need to know to stay abreast of developments in order to properly advise clients.  (Article available to NJSBA members here.)

On December 5, 2019, Bill has been invited by the Greater Middlesex/Somerset County Estate Planning Council to discuss the latest changes to family structures, both legal and in society, in a talk entitled “Estate Planning for the Modern Family.”

Are Your Rights At Risk?” was the subject of a seminar that bill gave to New Jersey clients at the Rutgers club on July 9, 2019.  Now, the Union County NJ Office of LGBT Affairs is holding a repeat of the seminar, in partnership with Singer & Fedun and Morgan Stanley, on October 22, 2019.  All are invited - see below.

Tuesday, October 22
6:30 PM – 9:00 PM
The Tavern at Ash Brook Golf Course
1210 Raritan Road, Scotch Plains, NJ

The evening seminar presentation will cover important life and family planning topics that directly affect LGBTQ families including marriage equality, protecting non-traditional family structures, portability of parental rights, estate planning, tax law, end-of-life issues, legal concerns facing trans/intersex communities, and a Q&A opportunity to speak with the presenters Bill Singer, Esq. & John Passante, Esq. of Singer & Fedun, LLC and Kate Sweeney & DW Kim from Morgan Stanley.

Admission is Free. Due to limited seating, registration is required.
