Heir Property and the Heir Property Act

Heir property is inherited, family-owned, real property (land) owned by multiple heirs with undivided interest.  

The Uniform Partition of Heirs Property Act would provide protections for heir property owners by balancing the rights of those who wish to keep the land in the family with the rights of family members who want to sell their share of the property at fair market value. The Act would only apply to heir property and has already been passed in several states.   The Act would allow family members to purchase the share of a relative who wants to sell and it would help the seller get fair market value for his interest while keeping the land in the family.

We encourage Arkansas lawmakers to pass this important legislation that would protect family land and our shared Arkansas heritage.  The legislature will next consider nonbudgetary issues in the 2015 legislative session.

Make sure to share this information with your family, perhaps over you holiday dinner table, to help support passage of the Heir Property Act in 2015.
   It will make a real and positive difference for many Arkansas families and communities.
