ONCA update

Because the Ontario legislature won’t sit again until September, there is no opportunity for the technical amendments bill related to Ontario’s Not-for-Profit Corporations Act, 2010 (ONCA) to be introduced until the fall of 2015 at the earliest.  That means that the ONCA is not expected to come into force before 2016.

The Get Ready for the ONCA project will continue to offer occasional ebulletins and speakers for webinars and teleconferences while we wait for clarity on when the ONCA will take effect.

For the latest information on the timing of the ONCA, please check the Ontario Ministry of Government and Consumer Services website at

http://www.sse.gov.on.ca/mcs/en/Pages/Not_For_Profit.aspx

Meanwhile, you can use CLEO’s tools to learn about the ONCA.

Student legal help service

Thanks so much to the 28 community organizations that helped CLEO test a live chat service and Q & A forum during May and June.  We tested options that may form part of a legal help service to answer questions related to the ONCA with the help of law students from Osgoode Hall Law School.  The process helped us learn more about the questions that nonprofits have, their knowledge of their governing documents, and how they want to interact with the legal help service.

We also learned that most nonprofits won’t or can’t make time to prepare for the ONCA until more details and the date when the law will take effect are clear.  As a result, we will select the launch date for the student legal help service after we know when the ONCA will take effect.
