NEW SALE & PURCHASE AGREEMENT
Yes, it’s here! Hill Dickinson solicitors have worked with us to deliver a new-look Agreement. The clauses are shorter and cleaner. The only areas to fill in are on the front page, with signatures on the back page, plus an Annex 3 for Additional Conditions. The Unconditional version and revised Listing Agreements will follow soon.

The new S&P is on the ABYA website Members’ area for you to download, together with the revised Guidance Notes to support the documents. Please get rid of all the old versions – some of you have VERY old versions!

TONNAGE MEASUREMENTS FOR THE MALTESE REGISTRY
Transport Malta only authorises recognised organisations or individuals appointed as Government Surveyors to issue Tonnage Certificates. In order for an individual to be appointed as a Government Surveyor, he/she has to meet all the established criteria which may be downloaded here. Transport Malta therefore recommends that if there is any individual that meets all the said criteria he/she may wish to apply accordingly.



RCD STATUS FOR EXPERIMENTAL BOATS
A new scenario arose recently which was referred to HPi Verification Services (HPi) about an experimental boat and its RCD status. HPi referred to the EU Commission’s Guide and found that if an experimental boat moved into the market, then the “first time on the market” rule applied for compliance. So if you are offered an experimental boat to sell, check that the Post Construction Assessment has been done. If not, it needs to be referred to an RCD consultant.
